By accessing the Site, purchasing, downloading, activating, or using our Expert Advisors/robots (“EA(s)”, “Software”), you agree to these Terms & Conditions. If you do not agree, do not use the Site or the Software.
1) Risk Warning & No Investment Advice
- Trading foreign exchange on margin carries a high level of risk and may not be suitable for all investors. You could lose some or all of your capital.
- Past performance (including backtests/forward tests) is not indicative of future results.
- The Software and Site content are provided for educational and informational purposes only and do not constitute financial, investment, legal, tax, or brokerage advice. You are solely responsible for your trading decisions.
2) Eligibility & Your Responsibilities
- You confirm you are at least 18 years old, legally capable, and authorized to enter into these Terms.
- You are responsible for ensuring your hardware, MT4/MT5 platform, broker, VPS, internet connectivity, and regional regulations are compatible and lawful for use of the Software.
- You agree to test the EA on Strategy Tester and a demo account first and to only deploy on a live account once you understand the risks and how the EA behaves with your broker conditions.
3) Products, Delivery & Updates
- Our EAs are digital products licensed for use on MetaTrader 4 and/or MetaTrader 5 (as stated on the product page).
- Delivery is via email and/or account download after successful payment. In rare cases delivery may take up to 48 hours (e.g., fraud checks, manual review).
- We may provide updates (bug fixes, compatibility fixes, preset refreshes) at our discretion. Updates do not imply future development obligations and may require a valid license.
4) License & Activation
- Purchases are one-time payments (no subscription), for the license type described on the product page (e.g., number of live accounts permitted; demo accounts may be unlimited unless stated otherwise).
- A license key and/or activation process may be required. We may collect MT4/MT5 Account ID(s), broker name/server, and activation logs to manage licensing and prevent abuse.
- You must not share, resell, rent, sublicense, transfer, disclose, reverse engineer, decompile, or distribute the Software, license key, presets, or documentation.
- Copying between live accounts requires appropriate licenses. If we detect unlicensed copying or key sharing, we may suspend or terminate your license immediately without refund.
5) Use Requirements & Presets
- We provide pre-configured settings/presets (e.g., Conservative/Moderate/Aggressive). You may adjust risk controls (e.g., lot size, equity protection, take-profit) within the bounds of your license.
- Using risk settings beyond our recommendations increases the likelihood of losses. You accept full responsibility for any settings you choose to deploy.
- You agree to run the EA on a demo account and in Strategy Tester first to validate broker execution, spread/slippage, commissions, and news behavior.
6) Refunds & Cooling-Off (Digital Content)
30-Day Refund (Unused Licenses Only)
- We offer a 30-day refund only if the EA has not been used.
- For this policy, “unused” means no license activation on any MT4/MT5 account (demo or live), no connection to our license server, and no use of downloadable content (e.g., presets) beyond initial receipt. We may verify this via license/activation logs.
- If the Software has been activated, installed, or used in Strategy Tester, demo, or live, the product is considered used and not eligible for refund.
Digital Content & Right of Withdrawal (UK/EU)
- If you are a consumer in the UK/EU, you may have a 14-day cooling-off right for online purchases. However, for digital content this right can be lost once you download/access the content after giving express consent to immediate supply.
- By downloading, activating, or accessing our Software/content, you acknowledge and agree that your right to cancel is waived to the extent permitted by law.
Process
- To request a refund (for unused licenses within 30 days), contact info@nexusforextrading.com with your order ID and email.
- Where permitted by law, refunds may exclude non-recoverable payment processor fees and currency conversion charges. We do not refund bank/wire fees.
- Chargebacks filed without first contacting us may be treated as license abuse and can lead to license termination.
7) No Liability for Trading Losses
- You acknowledge that markets can move rapidly and that spreads, slippage, gaps, platform outages, VPS/network issues, and broker restrictions can result in losses.
- Nexus Forex Trading is not liable for any trading losses, opportunity losses, lost profits, or lost data. You control your risk settings and deployment decisions.
8) Compatibility & Third-Party Services
- We provide reasonable email support for installation, activation, and basic usage during local business hours (as stated on the Site).
- Support does not include custom development, strategy modification, or broker-specific tuning beyond published presets/guides.

10) Intellectual Property
- The Software, presets, documentation, brand, and Site content are protected by copyright, trademark, and other IP laws.
- You receive a limited, non-exclusive, non-transferable, revocable license to use the Software strictly per these Terms.
11) Prohibited Conduct
You agree not to:
- Circumvent license or activation controls;
- Use the Software in violation of law, exchange rules, or broker terms;
- Misrepresent performance or make false claims using our brand;
- Upload malware, interfere with servers, or scrape/harvest protected data.
We may suspend or terminate licenses for violations.
12) Limitation of Liability
To the maximum extent permitted by law:
- We exclude all implied warranties (merchantability, fitness for a particular purpose, non-infringement).
- We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or trading losses, even if advised of the possibility.
- Our total aggregate liability for any claim arising out of or relating to the Software or these Terms is limited to the amount you paid for the license giving rise to the claim.
Nothing in these Terms excludes liability that cannot be excluded by law (e.g., fraud, death/personal injury from negligence).
13) Indemnification
You agree to indemnify, defend, and hold harmless Nexus Forex Trading and its officers, employees, and partners from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Software, breach of these Terms, or violation of law/third-party rights.
14) Privacy & Cookies
Our Privacy Policy and Cookie Policy (available on the Site) explain how we process personal data, use cookies, analytics, and license logs. By using the Site/Software you agree to those policies.
15) Pricing, Taxes & Billing
- Prices are shown on the product page and may change at any time.
- Taxes/VAT may be applied based on your location and law.
- Payment is processed by third-party providers (e.g., Stripe/PayPal). We do not store full card details.
16) Changes, Availability & Force Majeure
- We may modify the Software, presets, documentation, or Site at any time. We aim to maintain availability but do not guarantee uninterrupted operation.
- We are not responsible for delays/failures caused by events beyond our reasonable control (force majeure).
17) Links & External Content
Links to third-party sites/resources are provided for convenience. We are not responsible for their content, accuracy, terms, or availability.
18) Governing Law & Jurisdiction
These Terms are governed by the laws of England & Wales (conflict of law rules excluded). Courts of England & Wales have exclusive jurisdiction, except that consumers may have mandatory local rights.
19) Severability & Entire Agreement
If any provision is found unenforceable, the remainder remains in effect. These Terms, together with our Privacy/Cookie policies and any order confirmation, form the entire agreement between you and us regarding the Software.
20) Changes to These Terms
We may update these Terms from time to time. The “Effective date” will change accordingly. Material changes may be notified on the Site or via email. Continued use after changes constitutes acceptance.
